Dublin City Council gives notice to invoke Article 32.2(b) (ii) and (iii) for a derogation from public procurement whereby the works, supplies or services can be provided only by a particular economic operator as (ii) competition is absent for technical reasons and (iii) the protection of exclusive rights, including intellectual property rights. Contract for essential system upgrade and ongoing application support for a critical bespoke web application used by Dublin City Council Roadworks Control Online Entry (ROCE). Dublin City Council intends to award a contract to Genbase Solutions Ltd. for 2 years. The maximum value of this contract is €28,000 ex VAT. RCOE is a critical web application used by Dublin City Council (DCC) to manage and approve requests from external Utility Companies for work on public roads. Introduces in 2001, the system helps maintain compliance and handle public liability processing. It also ensures smooth traffic flow and pedestrian access during roadworks. The application allows Utility Companies to apply for permits to perform road works within DCC's administrative area, which includes 4107 roads and streets under DCC's control. Additionally the system sends emails to various users in order to process these permits. This contract includes the support and upgrade of a bespoke application initially developed in 2001 by GCI Ltd and then by Genbase in 2002 who took over the support and modification of the application.
